The Office of the Chief Medical Examiner arrived on the scene and took custody of the Mr. Despeignes at 5:09 pm.

During their investigation, detectives with the Boston Police Department were informed by witnesses that around 2:00 p.m., they were lying on their couch in their living room when they heard someone open the front door. The Witness believed it was most likely members of their family coming in and was surprised when they observed that two males had entered the home and were now standing on the landing at the top of the stairs.

This witness informed Detectives they recognized one of the males and knew this individual for about fifteen years, but they did not recognize the other male that he was with.

The two men stepped into the living room and requested that the Witness call a family member because they needed a ride. The two men then sat down on the couch and talked for about ten minutes. The individual who the Witness knew asked if the Witness had any marijuana and requested to take a shower. The Victim, Despeignes, then came down from the top floor of the residence and gave a “blunt” of marijuana to the individual who they knew. The Witness went upstairs to clean the bathroom, so the individual known to them could take a shower.

The Witness informed detectives that they heard the individual known to them call out to the Victim by their nickname and believed this individual was walking toward the Victim who was in the rear bedroom and then heard what they described as a “pop”. The Witness stated that they believed the “pop” was a gunshot and exited the bathroom, and went to the rear bedroom. While walking towards the bedroom, the Witness stated that the individual known to them passed by them and then ran down the stairs. The Witness stated that they looked into the bedroom and observed the victim lying on the floor. After seeing the victim on the floor, the Witness stated that they ran after the individual they knew and shouted at him, asking why he would do this. This individual turned and told the Witness that he had seen the Victim leaving his girlfriend’s house the night before.

The Witness described the male they knew to detectives, and the description given matched that of Austin Lee Dillon. The Witness informed police that the male they knew had Gucci symbol tattoo on his forehead between his eyes and believed that he had other tattoos on his face as well. Austin Lee Dillon has a distinct Gucci symbol tattoo on his forehead between his eyes.

Video of the area which was obtained and viewed by detectives shows at about 2:03 PM, two males closely matching the description that the Witness provided to detectives walking together from the area of Marcella Street and Ritchie Street onto Weaver Way, heading towards the Victims unit. At about 3:29 p.m., both males reappear on camera(s), leaving the area of Weaver Way and walking back towards Marcella Street.
